MANDATORY PRODUCER COVENANT • VERSION 1.0-2026SOUTH AFRICAN COPYRIGHT ACT 98 OF 1978

PRODUCER RIGHTS, PERMISSIONS & INDEMNITY DECLARATION

By publishing or offering a beat for licensing on Beatlam, every producer confirms, warrants, and agrees to the 14 mandatory statutory clauses set out below. Unverified accounts or producers who have not submitted this affirmative declaration are strictly prohibited from publishing listings or receiving payment settlements.

Important Legal Notice to Beatmakers:

Subscribing to a sample service (e.g., Splice, Loopcloud) or purchasing a sound pack does not grant automatic permission to register derivative works with YouTube Content ID or claim 100% exclusive composition rights if third-party master loops are incorporated. You are personally liable for any copyright infringement or unauthorized sampling.

Authoritative 14-Clause Declaration Text:

1

I am the original creator of the material I created, or I have obtained and retained all permissions, licences, assignments, consents and other rights reasonably required to offer the material under each licence I sell.

2

I have the legal authority to grant every right represented in my listing, including the rights relating to the musical composition, sound recording, samples, loops, interpolations, performances, stems and other included material, to the extent applicable.

3

I will not upload, sell or license material that I have stolen, copied without permission, obtained unlawfully, or included in a way that infringes another person's copyright, performers' rights, contractual rights, privacy rights or other enforceable rights.

4

I understand that buying a sample pack, downloading a loop, subscribing to a music service or obtaining a beat-making tool does not automatically give me permission to use every item in a commercial release. I am responsible for checking the actual terms and restrictions that apply.

5

Where material is subject to sample clearance, a third-party licence, co-producer approval, a publisher's rights, a label agreement or any other restriction, I will obtain all required permissions before offering the beat and will comply with those restrictions.

6

I will not misrepresent the origin, ownership, exclusivity, clearance status or commercial permissions attached to a beat.

7

I will keep reasonable records of my original work, source material, relevant licences and written permissions and provide appropriate evidence when reasonably requested to investigate a genuine rights complaint.

8

If I discover that a beat contains material I am not entitled to license, I will notify Beatlam promptly and cooperate with reasonable steps to stop further unauthorised sales and address affected customers.

9

I understand that Beatlam provides a marketplace through which producers can offer music licences. Beatlam does not automatically create, own, verify, clear or independently guarantee every beat uploaded by a producer.

10

To the extent permitted by applicable law, I accept responsibility for losses, claims, damages, reasonable legal costs and expenses caused by my breach of these declarations, my lack of licensing authority, or infringement arising from material I supplied or misrepresented.

11

I agree to indemnify Beatlam and its relevant personnel, and affected customers where legally appropriate, against third-party claims and reasonable losses arising from my breach, subject to applicable law, proof of causation, mitigation and any liability that cannot lawfully be excluded.

12

I understand that this declaration does not remove any legal rights belonging to artists, other rights holders or consumers, and does not protect me from liability for my own conduct.

13

I understand that Beatlam may restrict a listing, suspend sales, request evidence, preserve relevant transaction records or take other reasonable measures where there is credible evidence of infringement or an unresolved ownership dispute.

14

I confirm that the information I supply is accurate and that I will update it if my rights, permissions or licensing authority change.
