RIGHTS COMPLAINT & TAKEDOWN POLICY
Beatlam respects the intellectual property rights of musical artists, composers, sound recording producers, and rights organisations. This policy details our formal Notice & Takedown Procedure in accordance with South African copyright law and Chapter XI of the Electronic Communications and Transactions Act 25 of 2002.
5-Stage Notice & Takedown Protocol:
Submission of Notice of Infringement
Any copyright owner, publisher, producer, or authorized legal representative who reasonably believes that content offered on Beatlam infringes their intellectual property rights may submit a formal complaint via our online takedown form or directly by email to [email protected].
Required Notice Evidence & Particulars
The complaint must provide: (a) full legal name, physical address, and contact details of the complainant; (b) a clear description of the original copyrighted work; (c) the specific URL or beat listing on Beatlam alleged to infringe; (d) a declaration of good-faith belief; and (e) proof of copyright ownership, registration, or authority to act on behalf of the owner.
Immediate Protective Restriction
Upon receiving a substantiated notice containing the required statutory particulars, Beatlam will expeditiously restrict public access to the affected listing, suspend sales of the work, and preserve relevant audit, licensing, and transaction records.
Producer Notification & Counter-Notice Right
Beatlam will notify the affected producer promptly in writing, furnishing a summary of the complaint. The producer is afforded a fair opportunity (typically five business days) to submit a formal counter-notice establishing ownership, relevant sample clearance, or valid licensing authority.
Assessment & Resolution
If the producer fails to substantiate legitimate licensing authority or concedes the infringement, the listing is permanently removed. Where affected customers have purchased licences under material misrepresentation, Beatlam will take appropriate remedial actions including issuing refunds or notifying affected licensees as legally required.
